Terms of service

1. General provisions

Sottio Sp. z o.o. is the exclusive and official distributor of Santa Madre products in Poland.

The store conducts retail sales of Santa Madre products within the territory of Poland.

The Terms and Conditions set out the rules for using the store, placing orders, payments, delivery, returns, complaints and personal data protection.

The Terms and Conditions are available free of charge on the store's website and the customer may download, store and reproduce them in electronic form.
2. Definitions

Store – the online store www.santamadre.pl operated by Sottio Sp. z o.o.

Customer – a natural person, legal person or an organizational unit without legal personality that uses the store.

Product – an item available in the store, offered for sale by Sottio Sp. z o.o.

Terms and Conditions – this document defining the rules for using the store.

Sales Agreement – the agreement concluded between the customer and Sottio Sp. z o.o. in the manner specified in the Terms and Conditions.
3. Conditions of using the store

Using the store constitutes acceptance of these Terms and Conditions.

The customer agrees to provide true, up-to-date and complete information when placing an order.

The store reserves the right to temporarily limit product availability for technical, warehouse or logistical reasons.

The store reserves the right to verify customer data in case of suspected abuse or fraud.
4. Placing orders

Orders are placed through the store website by selecting products, adding them to the cart and completing the order form.

The customer chooses the delivery and payment method before placing the order.

Confirmation of acceptance of the order for processing is an e-mail sent to the address provided by the customer.

The sales agreement is concluded at the moment the store sends the confirmation of acceptance of the order for processing.

In the case of incomplete or incorrect order fulfillment, the store will contact the customer to determine further steps.
5. Prices and payments

Prices shown in the store are gross prices (including VAT).

All orders require payment in advance.

Payments are made exclusively via Shopify Payments, including supported methods: payment card, BLIK, instant online transfer.

The store reserves that orders will not be dispatched until payment has been credited.
6. Delivery

Products are delivered to the address indicated by the customer in the order form.

The store offers two delivery options:

Delivery costs are provided at the time of placing the order and are borne by the customer, unless the Terms or the offer state otherwise.

Delivery time is usually 2–5 business days from payment being credited, unless the product is marked as requiring an extended processing time.
7. Right of withdrawal (returns)

A customer who is a consumer has the right to withdraw from the contract within 14 calendar days of receiving the product, without giving any reason.

Returns should be reported via the customer panel on the store's website:

The returned product should be sent to the address:

The cost of return shipping is borne by the customer, unless the return results from a complaint or the product's non-conformity with the contract.

Products should be returned in a condition not showing signs of use beyond normal inspection, preferably in the original packaging.

Refunds will be made within 14 days of receiving the returned product, using the same payment method that was used for the purchase.
8. Complaints

The customer has the right to lodge a complaint about a product in the case of physical or legal defects or non-conformity with the contract.

The complaint should include:

description of the defect or non-conformity

photos of the product, if possible

Complaints are processed within 14 calendar days of their receipt.

If the complaint is upheld, the customer may receive: a replacement product, a repair, a refund or another solution consistent with consumer law.
9. Liability

Sottio Sp. z o.o. is liable for the conformity of products with the contract and for damages caused by the store's fault in accordance with the provisions of the Civil Code and the Consumer Rights Act.

The store is not liable for damages resulting from improper use of the products by the customer.

The store is not responsible for damages resulting from the actions of courier companies.
10. Personal data protection

Customers' personal data are processed in accordance with GDPR and the Personal Data Protection Act.

Data are used solely for the purpose of order fulfillment, handling returns, complaints and contacting the customer.

Detailed information regarding data processing is available in the store's Privacy Policy.
11. Final provisions

These Terms and Conditions come into force on 11 March 2026
-
The store reserves the right to change the Terms and Conditions; changes are published on the store's website.
-
Matters not regulated by these Terms and Conditions are governed by Polish law, including the Civil Code and the Consumer Rights Act.
